Privacy Policy
1.1. General Information
We process your data exclusively on the basis of the statutory provisions in accordance with the GDPR, the Austrian Data Protection Act (DSG), and the Austrian Telecommunications Act (TKG). The website operator named in the legal notice is the controller within the meaning of Article 4(7) GDPR. Since the protection of your personal data is of particular concern to us, we inform you below about the most important aspects of data processing within the scope of our website.
1.1.1. Purpose of Processing
The data is processed and stored for the purpose of operating an informative and representative website.
1.1.2. Duration of Storage
The data will be deactivated and blocked or permanently deleted after the purpose ceases to apply or at the request of the data subject, provided that no statutory retention obligations conflict with this.
1.1.3. Legal Basis for Processing
The data is published on the basis of our legitimate interest pursuant to Article 6(1)(f) GDPR. By doing so, we pursue the goal of providing the most comprehensive possible presentation of our company and thus offering users the best possible service.
1.1.4. Categories of Data
We process personal data both in the form of website content, images, and, where applicable, moving images, logos, and free texts, as well as data of the respective visitor in the course of using the contact form.
1.1.5. Categories of Recipients
The data is made available to the respective users of the website. These include consumers as well as business users. Data provided in connection with the use of the contact form is transmitted to the controller for the purpose of processing the inquiry.
1.1.6. Source of the Data
The data originates from the controller as stated in the legal notice and, where applicable, from the respective users.
1.2. Liability of Users
All users are obliged to comply with applicable laws, in particular data protection laws, and to indemnify and hold harmless the operator of this website in this regard. The use of contact data published within the scope of the legal notice obligation by third parties for the transmission of unsolicited advertising and informational materials is hereby explicitly objected to. The website operator expressly reserves the right to take legal action in the event of unsolicited advertising communications, such as spam emails.
The use of this website does not require the provision of personal data such as name, address, or email address. We collect and store such data only if and insofar as you voluntarily provide it to us (e.g. when subscribing to a newsletter).
1.3. Social Networks
Social media plugins (e.g. the use of social plugins from Facebook, Twitter, Instagram, etc.):
So-called social plugins (“plugins”) from social networks are used on our website. If you access a page of our website that contains such a plugin, your browser establishes a direct connection to the servers of Facebook, Google, Twitter, or Instagram. The content of the plugin is transmitted directly from the respective provider to your browser and integrated into the page. By integrating the plugins, the providers receive the information that your browser has accessed the corresponding page of our website, even if you do not have a profile or are not currently logged in. This information (including your IP address) is transmitted directly by your browser to a server of the respective provider.
Further information on the use of data can be found in the privacy policy of the respective network.
1.4. Videos
On our website, we offer you the possibility to view YouTube videos directly via iframe embedding. By clicking on a video, you grant consent pursuant to Article 6(1)(a) GDPR. Through this process, the service provider Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, may collect personal data from you for the duration of the playback of the respective video. No processing or storage of the aforementioned data is carried out by us.
Your consent remains valid until you leave the respective website and is not stored.
Google’s privacy policy can be found at:
https://policies.google.com/privacy?gl=AT&hl=de#intro
1.5. Google Fonts
External fonts, so-called “Google Fonts,” are implemented on this website. These web fonts are integrated via a server request, whereby the fonts are stored on the technical service provider’s own server.
1.6. Contact Form
If you contact us via the contact form on our website or by email, the data you provide will be stored by us and temporarily by our technical service provider for three months for the purpose of processing the inquiry and in the event of follow-up questions. This data will not be passed on to third parties.
The legal basis for data processing is Article 6(1)(a) GDPR if the user has given consent; for data transmitted in the course of sending an email, Article 6(1)(f) GDPR applies. If the email contact aims at the conclusion of a contract, Article 6(1)(b) GDPR applies.
1.6a. reCAPTCHA
To protect contact forms on our website, we use the reCAPTCHA service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). This query serves to distinguish whether the input is made by a human or abusively by automated, machine processing. It includes the transmission of the IP address and, where applicable, other data required by Google for the reCAPTCHA service. For this purpose, your input is transmitted to Google and further processed there. Google uses the information obtained, among other things, to digitize books and printed materials and to update services such as Google Street View and Google Maps.
Google’s differing privacy policy applies to this data and can be accessed at:
https://policies.google.com/privacy
1.7. Job Applications
If you apply for a position via the contact form on our website or by email, the personal data you provide will be stored temporarily for the purpose of verifying your application and during the subsequent selection process for the duration of the application process and will then be deleted. Processing the data is mandatory and necessary for participation in the application process.
If you have given your consent to keep your data on record, the data will be used for the aforementioned purposes for an additional six months and then permanently deleted. In this case, the legal basis for processing is Article 6(1)(a) GDPR. You may revoke your consent to the use of your data at any time by email to office@qmisoft.com. The data will then be deleted at your express request.
1.8. Google (Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA)
1.8.1. Google Maps™ Map Service
The Google Maps™ map service is used on this website in accordance with the Google Maps terms of use and the Google Services terms and conditions. We point out that inaccuracies and errors in the maps cannot be avoided and do not constitute a defect, as they represent an approximation of reality.
1.8.2. Google Analytics
Google Analytics is a web analytics service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). When our website is accessed, a connection to Google’s servers is established via the browser, and data is transmitted to Google servers, some of which are located in the USA. This is controlled by activating the associated cookie consent.
General and detailed information on data handling by Google Analytics can be found in Google’s privacy policy (https://policies.google.com/privacy) and Google Analytics’ privacy information (https://support.google.com/analytics/answer/6004245).
1.8.3. Google Analytics 4
We use “Google Analytics 4” in the most data protection–friendly manner possible. Google Analytics generates cookies to analyze website usage. Your IP address is definitively not available to us as personal data. Nevertheless, we receive only limited demographic information from Google Analytics and no data on user interests. We can obtain statistics on user origin such as city, country, and language; however, due to our settings, no age segment data and no user interest information are available. Our settings also prevent remarketing of the collected usage data with Google data.
1.8.4. Google Tag Manager
We use Google Tag Manager, a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Tag Manager manages and activates tags and JavaScript codes after consent has been granted for marketing purposes. If tracking scripts are involved, these are described separately in the privacy policy. Google Tag Manager does not store any personal data and does not access such data.
If deactivation has been carried out at the domain or cookie level, this remains in effect for all tracking tags implemented via Google Tag Manager. However, the tool triggers other tags that may themselves collect data. In this process, data may be transmitted to Google servers, some of which are located in the USA.
1.8.5. Google Ads Conversion
We use Google Ads Conversion to draw attention to our own offerings via advertising materials in the form of Google Ads on external websites. This allows us to display advertising that is of interest to users. These advertising materials are delivered by Google via so-called “ad servers,” whereby a direct connection to Google’s server is automatically established.
The extent of data usage collected by Google in this context is beyond our knowledge. Google may obtain and store your IP address.
1.9. Conversion Tracking with the Meta Visitor Pixel
Within our online presence, the “visitor action pixel” or “Meta Pixel” of Meta Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”), may be integrated. This allows us to track the actions of users who have viewed or clicked on a Facebook advertisement and to measure the effectiveness of Facebook advertisements for statistical and market research purposes.
The data collected in this way is anonymous and does not contain personal data of individual users. However, this data is stored and processed by Meta. Meta may link this data to your Meta account and also use it for its own advertising purposes in accordance with its data usage policy:
https://www.facebook.com/about/privacy/
You can allow Facebook and its partners to place advertisements on and outside Facebook. A cookie may also be stored on your device for these purposes.
This consent may only be given by users who are over 13 years of age.
1.10. EU–US Data Privacy Framework
Since the “Standard Contractual Clauses” (SCCs) were replaced by the so-called “EU–US Data Privacy Framework,” which entered into force on 10 July 2023, the transfer of personal data to the USA is now essentially permitted under the same mechanisms as under its predecessor, the “Privacy Shield.”
If a US company certifies itself under the “EU–US Data Privacy Framework,” it establishes a level of data protection deemed adequate under European data protection laws. As a result, personal data may be transferred from Europe to such a company without the need for additional safeguards pursuant to Article 46 GDPR.
A register of US companies certified under the DPF can be found at:
https://www.dataprivacyframework.gov/s/participant-search
1.11. Wix Analytics
Our website uses functions of the web analytics service Wix Analytics. The provider of the web analytics service is Wix.com Ltd., Nemal St. 40, 6350671 Tel Aviv, Israel. Wix uses cookies. Information generated by cookies about your use of our website is transmitted to a Wix server and stored there. The server location is generally the USA.
Processing is carried out exclusively on the basis of your consent pursuant to Article 6(1)(a) GDPR. Consent is obtained via the consent tool used and can be withdrawn at any time. As the operator of this website, we have a legitimate interest in analyzing user behavior in order to optimize our website and, if applicable, advertising.
IP Anonymization
We use Wix Analytics in conjunction with the “IP anonymization” function. This ensures that Wix shortens or anonymizes your IP address within member states of the European Union or other contracting states of the Agreement on the European Economic Area before transmission to the USA. On our behalf, Wix will use this information to evaluate your use of the website, to compile reports on website activity, and to provide us with other services related to website and internet usage.
1.12. Cookies
We use cookies to personalize content and advertisements. Cookies are small text files that are used by websites to make the user experience more efficient. According to the law, we may store cookies on your device if they are strictly necessary for the operation of this website. These cookies serve in particular the following purposes: maintaining session functionality, protection against security risks and unauthorized access, load balancing and technical optimization, as well as the storage of language settings and technical preferences.
Technically necessary cookies include, in particular, session and security cookies, which are automatically deleted when leaving the website or have a short storage duration. Processing is carried out on the basis of our legitimate interest pursuant to Article 6(1)(f) GDPR and Section 165(3) of the Austrian Telecommunications Act (TKG) 2021, as these cookies are essential for the operation of the website and cannot be deactivated.
